On May 5, a decree of the Government of the Russian Federation came into force, approving the list of technological equipment and spare parts for it, imported as part of the implementation of investment projects, which are allowed to be imported into the Russian Federation before filing a declaration for goods.

On March 26, 2022, Federal Law No. 74-FZ of March 26, 2022 “On Amendments to Certain Legislative Acts of the Russian Federation and on the Suspension of Certain Provisions of Legislative Acts of the Russian Federation” came into force, which, in particular, supplemented Article 105 of the Federal Law of 08/03/2018 N 289-FZ paragraph 10.1 of the following content:

“10.1. The Government of the Russian Federation has the right to determine the list of categories of goods imported as part of the implementation of investment projects that may be declared for release prior to filing a declaration for goods.”

The Government of the Russian Federation has developed such a list of categories of goods imported as part of the implementation of investment projects, and adopted the corresponding document.

On May 5, Decree of the Government of the Russian Federation dated April 2, 2022 N 567 “On determining the list of categories of goods imported as part of the implementation of investment projects that can be declared for release before filing a declaration for goods” came into force.

The list of categories of goods imported as part of the implementation of investment projects that can be declared for release before filing a declaration for goods:

  1. Technological equipment, components and spare parts for it, raw materials and materials imported for exclusive use on the territory of the Russian Federation, in respect of which, as part of the implementation of an investment project corresponding to the priority type of activity (sector of the economy) of the Russian Federation, a tariff privilege is provided, provided Clause 1.1 of Article 34 of the Law of the Russian Federation of May 21, 1993 N 5003-1 “On the Customs Tariff”.
  2. Goods imported under agreements on the protection and encouragement of investments, which are concluded by the Russian Federation and signed on its behalf by the authorized federal executive body in accordance with the Federal Law “On the Protection and Promotion of Investments in the Russian Federation”.
