Federal Law No. 289-FZ of 03.08.2018 “On Customs Regulation in the Russian Federation and on Amending Certain Legislative Acts of the Russian Federation” was signed by the President of the Russian Federation on August 3, 2013 and officially published on the Legal Information Portal on August 4, 2018. This federal law establishes not only the procedure for customs regulation in the Russian Federation in accordance with the EEC CS, but also the sequence in which certain articles of the Federal Law of 27.11.2010 No. 311-FZ “On Customs Regulation in the Russian Federation” cease to be effective.

The document comes into force in accordance with Article 388 of Law 289-FZ “On Customs Regulation in the Russian Federation and on Amending Certain Legislative Acts of the Russian Federation” 30 days after the day of its official publication (from 04/09/2018), with the exception of provisions , for which this article establishes other terms of entry into force.

Federal Law No. 311-FZ of 27.11.2010 “On Customs Regulation in the Russian Federation” after the entry into force of the new federal law loses its force not completely, but with regard to the application of separate articles in accordance with p. 1 of Article 387 of Federal Law of 03.08.2018 No. 289 -FZ “On Customs Regulation in the Russian Federation and on Amending Certain Legislative Acts of the Russian Federation.”

The remaining articles of Federal Law No. 311-FZ of November 27, 2010 remain valid and will cease to be effective later in accordance with clauses 2-5 of article 387 of Federal Law No. 289-FZ of August 3, 2013.

In particular, this article regulating the procedure for obtaining the status of AEO (section 8, article 86, article 88-95) – they remain valid until 01.01.2020, And also the articles concerning the procedure for payment and return of advance payments, customs fees and the guarantee of payment of customs payments (p. 1-8, article 116, article 117. h 4-5, article 120, article 121,122. Part 2 – 3 article 128, part 1 article 129, article 147-149). These articles will become invalid only after the entry into force of the international Treaty of the Russian Federation providing for amendments to annexes 5 and 8 to the EAEU Treaty of 29.05.2014. (Protocols on the procedure for the transfer and distribution of the amounts of import customs duties (other duties, taxes and fees having equivalent effect), their transfer to the income of the budgets of the member States) and the application of special protective, anti-dumping and countervailing measures in relation to third countries).
